Terms of usage

By using our online services you (the customer) agree to abide by our terms and services. When you agree to utilize our services, you affirm that you are the owner or have full permission to alter any material turned over to us. We cannot be held liable now or in the future, in any legal action taken wherein this material in any form is actionable. You must be at least 18 years of age for us to have an account opened/or make payments/ receive copyright releases. Otherwise a legal guardian/parents/ or company must give written permission to us regarding our services if the work concerns minors.

Work for hire

Any and all work performed by us for our customers is to be considered work for hire under Section 101 of the United States Copyright Act, giving our customers full control of the composition, unless a mutual agreement is reached to the contrary (this is not our normal business practice). And as such, is the sole responsibility of you the customer. Our company assumes no legal rights or responsibilities to any such work. However, any work done by us must be included in your credits and we reserve the right to place a non-commercial snippet and links of your song/publication on our websites to display the work that we have done. In addition (by agreement only) KeySound Records reserves the right to submit the work that been published utilizing our services to various music and audio technical awards that will benefit both company and client.

Turnaround Time, in most cases

Preview will be returned to you, seven to fourteen business days (depending on chosen services) after recite. Upon your ok and full payment, we will return your completed masters within ten business days. Any revisions may be requested for an additional charge per change within a ninety day period. If you require rush service, notify us and explain your needs we will be happy to customize your order if at all possible.

Responsibility

Our company reserves the right to modify our terms and services at any time without notification to current or previous customers. Further more the company reserves the right to refuse or terminate any business for cause. Upon completion and final payment for your tracks, we will retain your material for a period of ninety days. We will not be responsible for any material left delinquent after that period of time. If the final payment is not made the work will remain property of KeySound Records and may be subjected for reuse and /or resale (mainly concerning song writing and lyric stock) / or to be deleted from our database.

Payments

Our company accepts payments via Pay Pal with any major credit cards. We are not responsible for any fees associated with their terms of services. If the final payment is not made the work will remain property of KeySound Records and may be subjected for reuse and /or resale (mostly concerning song writing and lyric stock).

Delay in completion of work submitted

Unexpected occurrences such as:

Power interruptions, major internet glitches, personal tragedies and any Acts of God that may delay the completion of a product, the company will not be held responsible for. However in any such case the company will make all efforts to return your completed works to you as soon as possible.

Deposits

Some of our services require a fifty percent non refundable deposit. Specific services require a full payment before any work is done due to its nature.

MASTERING, STEM MASTERING

One song (Stereo File Only ) risk free- after submission and payment for the first song we will send you short versions of your master track for your evaluation. If you are not completely satisfied we will return your payment in full upon your notification that must be made within 2 business days of receipt. If we agree to minor revisions we may elect to proceed at no extra cost to you - the customer. In this case standard rates apply and the customer will receive the completed package.

Albums, Multiples, Stem Mastering (up to 10 stems) - require full payment with submission and any modification must be paid upon notification. Only after final payment is confirmed will the customer be sent the completed package in commercial digital formats.

MIXING AND MASTERING BUNDLE

Requires full payment with submission and any modification must be paid upon notification. Only after final payment is confirmed will the customer be sent the completed package in commercial digital formats.

COMPOSITION & ARRANGEMENT, SONG WRITING & LYRIC STOCK

Requires fifty percent non refundable deposit (in most cases) after suggested package evaluation and any modification must be paid in full upon notification. We will give you updates promptly for your review (40 seconds or more per song) within at least 7-14 business days of your submission date in mp3/or text formats. Upon completion full payment is required. Only after final payment is confirmed will the customer be sent the completed package and/or copyright release notice. If the final payment is not made the work will remain property of KeySound Records and may be subjected for reuse and /or resale (mostly concerning song writing and lyric stock).

ROCK BAND NETWORK

Requires full payment with submission and any modification must be paid upon notification. Only after final payment is confirmed will the customer be sent the completed package or conformation of publication (for non US artists or labels). KeySound Records reserves the right to evaluate all submissions and reject content that is not appropriate or possible to be authored for RBN. In that case you may choose another company for authoring process. We would like to make the best and most fun to play product for the game. The client may be advised due to to content (explicit or suggestive) of the possibility of non acceptance by creators of RBN as the game is rated T(TEEN). At which point if the client decides to proceed KeySound is responsible only for authoring and programming the material. The process for authoring may take up to 100 man hours or up to 3 weeks. Publishing process may take 4-6 weeks for creators approval and placement into the RBN store.

US Residents 18+ years old:

Additional price of $100 dollars a year may apply by Creators and Microsoft for XNA account that allows you to control your submission and collecting royalties.

Non US Artists and Companies:

You have to assign your rights for submission legally for some US Resident or US company to publish your material into the game and collect royalties on your behalf . KeySound Records provides such services for non US artists and companies. Please feel free to contact us about any questions concerning this matter. KeySound will provide legal licensing and disbursements agreements for artists and companies outside of USA.

Terms of usage

In keeping with our privacy policy. None of your personal information submitted to us, will be shared with any other entity outside of our company unless you give explicit permission or a legal request is made by the proper authorities. To order, we make a personal account. This account requires private information such as, your physical address, email address, full name, country, state or province, zip code and your telephone number. All of this information is necessary to ship to and/or bill the customer/or copyright release. If we encounter any problem, we may email or contact you by telephone. You must be at least 18 years of age for us to have an account opened for you. As our business develops, we may sell or buy assets. In such cases customer information is considered an asset and may be shared with a subsidiary, merger partner or parent company. We further reserve these rights in the event of a major restructuring of this company.

Such as, change of e-mail address, zip code, phone number may be done by sending us an updated e-mail with new information.
